    Our last newsletter was ready for printing when the terrible tragedies of September 11, 2001 took place in   New York and Washington D.C., so we didn't address terrorism at that time. In this issue we are addressing terrorism, domestic terrorism, which has been going on in this country for quite a while. Unfortunately, this domestic terrorism was pretty much accepted because it fell within the realm of political correctness, and the perpetrators were fighting evil.  These domestic terrorists are no different than the international terrorists who attacked our way of life, killing many of our citizens, in an attempt to force us to accept their ideology. Trouble is that the domestic terrorists are not prosecuted very vigorously except for those accused of picketing abortion clinics, which the politically correct regard a major evil. Al Campbell, Field Editor Fly Anglers on line magazine wrote the following article, Terror On The Domestic Front, an article that appeared in The Rapid City Journal, in condensed form. PARR feels the facts covered by this article will be of great interest to our readers. Terror on the Domestic Front

      It's been several months since the people of this country watched the first clips of loaded passenger planes crashing into crowded buildings in New York.  Since that time we have been forced to deal with mailed anthrax and other threats of violence.  These acts have affected our country in many ways.
      Terrorists attack the very heart of freedom.  They fight against free will and free speech.  They use any tactic possible to frighten as many people as possible in an attempt to force a change in the way we live.  In a way, our innocence is lost forever.  We have been morally raped by a group of people bent on the idea of imposing their will on our country and each individual who lives here.
      Tyranny isn't a new idea.  It has lived in the hearts of men since the beginning of time.  It has many names; Hussein, Stalin, Hitler and bin Laden are only a few.  It lives in many groups; some we recognize as terrorist groups and some we rarely consider that way.  It lives in the heart of this country as well as elsewhere.
      Something we don't usually consider is the way terrorism has been aimed at sportsmen and other outdoor enthusiasts for many years.  We don't notice the impact domestic terrorists have had on our lives and economy.  We rarely weigh the costs of domestic terrorism on our daily lives.
      What am I talking about?  I'm talking about two costly movements that are alive and well in this country.  I'm talking about groups with international ties and activities.  I'm talking about the animal rights and environmental movements that sometimes operate in our own home towns.
      Have you ever heard of PETA (People for the Ethical Treatment of Animals) or ALF (Animal Liberation Front)?  The ALF is listed as a terrorist organization by the FBI; with hundreds of fire bombings, assaults and acts of vandalism to its credit.  You may remember a ski resort in Colorado that was torched by this organization.  More recently (Sep. 9, 2001) the ALF firebombed a McDonald's restaurant in Tucson, Arizona and made their claims public on Sep. 11th shortly after international terrorists hit New York and Washington DC.  Even more recently was an attack on a Ronald McDonald house in Tucson that defaced the building and terrorized the guests that were staying there while they visited seriously ill family members.
      What you might not remember are the bombings of medical research laboratories working on cures for the diseases of this world.  You might not recall how research working to find cures for childhood killers like SIDS and other sleep related disorders was stopped by animal rights extremists vandalizing the Texas Tech University Health Science Center in 1989.  You might not recall the firebombing of the medical research facilities at Michigan State University in 1992, or the destruction of years of AIDS research at the University of Arizona in 1989 by these terrorists.
      What do PETA and ALF have in common?  If you consider that PETA has funded the legal defense of ALF terrorists caught in the act of terrorism, or that PETA encourages its members to support the ALF bodily and financially, you can see the ties.  Add Greenpeace, the Humane Society of the United States (not to be confused with local Humane Society groups), Fund for Animals, the Society for the Prevention of Cruelty to Animals (SPCA) and a dozen other "animal rights" organizations to the list of groups with ties of some kind (at least in ideology) to PETA and the ALF.  While we're at it, add attacks, sometimes violent, on sportsmen, people in restaurants that serve meat and people wearing leather or fur.  These aren't just groups with kind thoughts toward animals.
      On another front there are groups who drive spikes into trees in an effort to hurt or kill loggers who are legally cutting trees for lumber.  Add vandalizing machinery, spiking roads, bombing lumber mills, mail bombings and other violent acts to the credit of the "green terrorists".  In addition to the open acts of violence, add the years of legal battles that tie up natural resources in court and prevent the proper management of our forests.  Small "enviro" groups constantly hold our natural resources hostage to their narrow views.  You should be aware that the ELF (Earth Liberation Front) is the breeding ground for such terrorism; and groups like the Sierra Club, Earth First, the Wilderness Society and dozens of other "enviro" groups offer active, passive or ideological support to these terrorists.  You should also be aware that there are strong ties between the animal rights and environmental movements, and the terrorist organizations at the core of each movement.
      All terrorist groups believe they hold the higher ground.  They claim to be superior in their religion, race, moral or ethical beliefs, intelligence or intellectual status, or to have higher or more correct political views.  They claim the rest of the world is somehow inferior to them because they have that superiority.  In other words, they strive to deprive us of our freedom and to impose their beliefs on us.  They are committed to the idea that they are right and the rest of the world is wrong.
      It's strange how these groups, who by their very nature and activities rely on their rights to free speech, press and protest, work so hard to deny other the same rights.  While they enjoy all the freedoms the constitution of this country provides, they fight to deprive others of those same freedoms, and are willing to destroy or even kill (remember the uni-bomber?) to force their beliefs on the rest of the world.  It's time for the people of this country to stand up and openly oppose these terrorists and the groups who support them under the banners of animal rights and the environment.
      I'm fighting mad about the terror that hit our country from the air on the 11th of September.  It was an attempt to impose the narrow views of a minority group of people on the will of a great nation and the world.  I'm also fighting mad about the terrorism that has been hitting us from within our own country for decades.  In terms of human lives lost, there is a difference; but the focus of both groups is to impose their narrow views and values on the rest of the world.  In that sense, domestic terrorists aren't very different from the guys who piloted the airliners into the buildings in New York and Washington DC.

Polar Bear Treaty, More Econonsense
      The following is based on an article by Charles Krauthammer: Here we are, for the second time in a decade, risking American lives in a war against an enemy fueled and fed by oil money.
      Here we are again decrying our dependence on oil from particularly unstable, unfriendly part of the world.  Here we are in desperate need of both energy conservation and new energy production.
      In addition, here we see that we may be prevented from drilling in the single most promising area on this continent because of a polar bear treaty:  “Polar Bear Agreement Cited By Drilling Foes"
     Now, I like polar bears as much as the next guy does.  I like pandas, caribou, and all the furry cuddlies on God’s good earth.  But I also like American soldiers.  And I do not like seeing them shot and killed in wars that would be both more avoidable and more winnable were we not so overwhelmingly dependent on energy supplies from the dung dump of the world, inhabited by unpleasant people who use our oil money to physically enforce their hatred of us and our success.
     At a time when Washington should be working on a crash program of conservation and new drilling, a 6-year-old report from the Fish and Wildlife Service is leaked in the hope that a 28-year-old polar bear treaty might derail drilling in the Arctic National Wildlife Refuge.
      The Interior Department stoutly maintains that the polar bear agreement does not prohibit oil exploration.  Alaska's Sen. Frank Murkowski points out that the 25,000 or so Arctic polar bears that he represents seem to be quite happily lolling around the existing oil drilling in Alaska.
      I, too, have little doubt that the polar bears will do fine, just as the caribou have thrived around the Prudhoe Bay field.  However, the whole debate is surreal.  We are at war, are we not?  Americans are fighting.  In Washington, D.C., and New York, nearly 5,000 have already been killed.  Fifteen of the 19 murderers were Saudi.  Their leader is Saudi.  Most of their money is Saudi.  And that same Saudi money funds the madrassas, the fundamentalist religious schools where poor Pakistani, Afghan and Arab children are inducted into the world of radical Islam and war against the American infidel.
      Yet we bow and scrape to the Saudis.  We beg and borrow.  We tolerate their deflecting onto America the popular hatred that would otherwise be directed at their own corruption.  Why?  Because we need their oil.
     The war on terrorism will be fought in many places.  Alaska is one.  We have known since 1973 that we need to reduce our dependence on Persian Gulf oil.  However, we have never been serious.  It was assumed that Sept. 11 would make us serious.  Instead, we are engaged in exegeses on polar bear mating habits and a ridiculous debate that pits conservation vs. drilling. Why one and not the other is beyond me.
      Every additional barrel that substitutes domestic oil for foreign oil is a victory.  Drilling in the Arctic will involve less than 1% of the arctic refuge.  It might produce an additional million barrels a day.  The sea of natural gas beneath could be the largest in North America.
      Yet, the Luddites stand firm, as if Sept. 11 never happened.  Sen. John Kerry (D-Mass.) vows a filibuster if anyone dares legislate Arctic drilling.
      Imagine where we would be if those railing against Arctic drilling today had prevailed 30 years ago and stopped Prudhoe Bay.  The million barrels a day we now get from Alaska would be coming from Saudi Arabia.  We would be even more in their debt and under their thumb.
      Let's put the size of the proposed drilling area in perspective. An average home lot is 50' x 100' or 5,000 square feet or 720,000 square inches.  Alaska is about 378,000,000 acres in size.  If we compare Alaska with an average home lot we get a representation of 525 acres per square inch.  The Arctic National Wildlife Refuge covers 19,500,000 acres; that's 37,142.857 square inches or about 16' x 16' on your lot.  The area we need to open up for exploration is 1,500,000 acres; that's 2,857.143 square inches or about 4.5' x 4.5' on your lot.  The actual area occupied for exploration is around 2,000 acres or 3. 809 square inches on your lot.  That is a spot a little less that 2" x 2" or the about the size of a 35mm slide mount.  The United States is about 3,615,100 square miles.  Alaska is about 591,000 square miles or about 16% of the U.S. land mass.  If your lot represents the state of Alaska, then from that 2"x2" spot you would supply all the energy needs for yourself and five of your neighbors for the next 30 years or more.

America's Wealth Foolishly Left Untapped

      To maintain our position as the economic leader of the world, The United States of America, needs something to sell on the global market in order to maintain that status.  Our oil remains in the ground, our minerals remain in the ground, the only thing we have to sell is our know how, and the rest of the world is catching up fast.  Unfortunately eco-kooks spouting rhetoric about pristine wilderness really doesn't really sell on the world market. Some people still have to work to support those who go skipping through life chucking rose petals.
     Thank God for the move, in October, by The Interior Department which removed a key provision from a Clinton era rule that would have allowed regulators to block gold, silver and copper mines even after they passed all environmental tests.
     The Bush administration left the so called "hard-rock mining rule" largely in tact, but dropped a section that gave the interior secretary the power to block mining projects likely to cause "sustainable and irreparable" harm to federal land.
     The government said it deleted the provision because it raised "serious policy and legal questions." Environmental groups said they would challenge the revised mining rule in court.
     The rollback of the hard-rock mining measure is a blow to environmentalists who say Interior Secretary Gale Norton is failing to protect federal land from undue harm.
     "This is a grave disappointment. These regulations don't address a vast majority of the problems caused by mining," Lexi Shultz, director of the Mineral Policy Center in Washington, said "We will be challenging (Norton's) legal authority to issue these rules."
     Environmentalists had celebrated the Clinton policy as the first significant change to U.S. mining rules since a weaker set of revisions was passed in 1980.
     Larry Finfer, spokesman for Interior Department's Bureau of Land Management, defended the agency's move to delete the controversial provision giving a Cabinet official the ultimate authority to veto a mining project.
     Lawyers for the Interior Department said the provision would not stand up in court, partly because it was added by the Clinton administration too late in the rule making process without giving the public time to comment on it.
     The provision was bitterly opposed by the mining industry, which said a company might spend millions of dollars to meet environmental standards, only to see a project vetoed.  "It's sort of saying you've cleared all 10 hurdles but you lose anyway," said Finfer. "That's hard to defend on fairness grounds."
     The Bureau of Land Management already has the authority to reject a mining project if it fails to meet federal standards for clean air and water, or to protect endangered species. The BLM oversees about 264 million acres of U.S. land.
    The Bush administration chose to keep several standards from the earlier draft, including one requiring all mining companies to post bond to cover cleanup costs.
    The new rule is scheduled to take effect Dec. 31. Regulators began working on the hard-rock mining rule during the first President George Bush's administration.

      A  woman pranced in her semi clad body during a People for the Ethical Treatment of Animals protest against people wearing animal skins and eating meat. If this woman truly thinks that by eating veggies and showing goose flesh she's somehow ethically superior to us omnivores, she should check and see how many little not-so-cute life forms are sliced, diced, burned, buried and chemically cleansed to appease her voracious appetite for leafy/nutty alternatives.
      It wouldn't surprise us if, more lives of animals are lost to the till than to the butcher, but were certainly not going to dance around covered by a spinach leaf grieving for the moles, voles, rabbits, etc.

The following highlighted text is verbatim, exactly the way it came off my Internet server: how can you call your selves Americans.. You are the farthest thing from it. You need to get your facts straight before you attack people. I am not Indian.. But I am educated and you are wrong!
    Wow! with such a powerful literary expression I may just  repent, denounce my right to think and convert to socialism.
    Evidentially if one makes the claim that they are educated they can denounce anyone without authentication. If I am not American, then whose army did I fight in for three years?

Will the “We Demand More” Ever End?

     Another Tribal garb is being jockeyed into  position; so, I wrote the following to our new Governor to try and get a handle on where he stands:
   Dear Governor McCallum, in a recent news article it was brought to PARR's attention that you are reviewing the length of time for the gambling contracts to last.  First, let us state that we are using the word gambling and not gaming and contract and not compact because that is exactly what they are.  You have stated that you are against any expansion of gambling, and this most certainly is just that!  The tribes are using the excuse that this will get them divested more, because of the time frames involved.  Every year the tribes hold the sportsmen of this state hostage until they decide how many fish they want and then the rest of the paying public gets what is left.  This is the DNR's version of 50/50, we might add!  Now they want more time!!!!!  Spring walleye spearing, spring and winter musky spearing, and shooting deer out of season deserve more attention than they are getting!!  Why give the tribes any more period?  PARR noted that the consultant for this recommendation was working for the forest county Potawatomi.  What a surprise that he recommended more time!  One of his reasons was that gambling is the biggest business in northern Wisconsin and one of its biggest employers.  That sure says a lot about our state.  If the money was not going to gambling it could go to other businesses that "pay state taxes?”  Your predecessor's office told me that the tribes hold their "special" rights over our heads every time that the gambling contracts are due. Are they doing that again?  Five years is to long of a time it should be yearly just like the special rights the tribes impose on the rest of the citizens, who pay state taxes we might add!

What's Next?

     Currently a Washington tribe, The Yakama, is associated with PacifiCorp in an effort to take over a series of dams on the Columbia River.  The Yakama tribe and PacifiCorp plan on submitting a license application to run the Priest Rapids project.  Currently the Grant County Public Utility District, which owns and operates the Priest Rapids and Wanapun dams, has their Federal Energy Regulatory Commission license to operate this utility and it expires in 2005. Such a take over would put a non republican form of government, the Yakama tribal government, in control of that utility service which in turn places its customers and citizens, within that utility district, in a position where they could not participate in the government that controlled their utility.  From rate increases to rules and regulations regarding being fish friendly, spills control during a drought, contract negotiations with user customers such as Seattle Light, Tacoma Power, and Puget Sound Energy, just to name a few, the tribal government would be the only government body in charge.  The other partner is predominantly owned by Scottish Power of Great Britain.
     So here we go a pretend government (not authorized under our Constitution) and a foreign corporation seeking to dislodge the Grant County PUD!  This is just one more wake up call for the citizens of Washington: allow this to happen and you continue to loose control of public utilities to "outsiders"... Non citizens and pretend governments.  What is next?

Hanoi Jane!

      I know the following has nothing to do with Indians or rights, however it has everything to do with patriotism. Veterans Day Nov.11th and the 60th anniversary of Pearl Harbor have just past. Therefore, to pay tribute to the memory of the great patriots that suffered and died for their country, the need arises to expose the deeds of Jane Fonda who is being honored as part of “100 years of Great Women” The following written by Rolf Brunner exposes this traitor:
    "This is for all the kids born in the 70's that do not remember this, and didn't have to bear the burden, that our fathers,
mothers, and older brothers and sisters had to bear:  Jane Fonda is being honored as one of the "100 Women of the Century."
     Unfortunately, many have forgotten and still countless others have never known how Ms. Fonda betrayed not only the idea of our country but specific men who served and sacrificed during Vietnam.
     The first part of this is from an F-4E pilot. The pilot's name is Jerry Driscoll, a River Rat. In 1968, the former Commandant of the USAF Survival School was a POW in Ho Lo Prison the "Hanoi Hilton." Dragged from a stinking cesspit of a cell, cleaned, fed, and dressed in clean PJs, he was ordered to describe for a visiting American "Peace Activist" the "lenient and humane treatment" he'd received. He spat at Ms. Fonda, was clubbed, and dragged away. During the subsequent beating, he fell forward upon the camp Commandant's feet, which sent that officer berserk. In '78, the AF Col. Still suffered from double vision (which permanently ended his flying days) from the Vietnamese Col.'s frenzied application of a wooden baton.
     From 1963-65, Col. Larry Carrigan was in the 47FW/DO(F-4Es). He spent 6 years in the "Hilton" the first three of which he was "missing in action".  His wife lived on faith that he was still alive. His group, too, got the cleaned/fed/clothed routine in preparation for a "peace delegation" visit. They, however, had time and devised a plan to get word to the world that they still survived. Each man secreted a tiny piece of paper, with his SSN on it, in the palm of his hand. When paraded before Ms. Fonda and a cameraman, she walked the line, shaking each man's hand and asking little encouraging snippets like: "Aren't you sorry you bombed babies?" and "Are you grateful for the humane treatment from your benevolent captors?"
     Believing this HAD to be an act, they each palmed her their sliver of paper. She took them all without missing a beat. At the end of the line and once the camera stopped rolling, to the shocked disbelief of the POWs, she turned to the officer in charge and handed him the little pile of papers. Three men died from the subsequent beatings. Col. Carrigan was almost number four but he survived, which is the only reason we know about, her actions that day.
      I was a civilian economic development advisor in Vietnam, and was captured by the North Vietnamese communists in South Vietnam in 1968, and held for over 5 years. I spent 27 months in solitary confinement, one year in a cage in Cambodia, and one year in a "black box" in Hanoi. My North Vietnamese captors deliberately poisoned and murdered a female missionary, a nurse in a leprosarium in Ban Me Thuot, South Vietnam, whom I buried in the jungle near the Cambodian border. At one time, I was weighing approximately 90 lbs. (My normal weight is 170 lbs.) We were Jane Fonda's "war criminals."
     When Jane Fonda was in Hanoi, I was asked by the camp communist political officer if I would be willing to meet with Jane Fonda. I said yes, for I would like to tell her about the real treatment we POWs received different from the treatment purported by the North Vietnamese, and parroted by Jane Fonda, as "humane and lenient."  Because of this, I spent three days on a rocky floor on my knees with outstretched arms with a large amount of steel placed on my hands, and beaten with a bamboo cane till my arms dipped.
      I had the opportunity to meet with Jane Fonda for a couple of hours after I was released. I asked her if she would be willing to debate me on TV. She did not answer me.
      This does not exemplify someone who should be honored as part of "100 Years of Great Women." Lest we forget..."100 Years of Great Women" should never include a traitor whose hands are covered with the blood of so many patriots. There are few things I have strong visceral reactions to, but Hanoi Jane's participation in blatant treason, is one of  them.

      As you are probably aware, the voting results in Florida are in and George W. Bush has been our President for almost a year now.
      Barbara Streisand, Martin Sheen, Susan Sarandon, Whoopie Goldberg, Alec Baldwin -- among many others -- have sworn to leave the country if George W. Bush is elected President.
     The prediction that this was to have catastrophic results in our vital -- no, indispensable -- entertainment industry, was just so much babble-speak. Actually, we have a creditability bankruptcy here…they are all here yet. Now it's time to contact them and remind them of their asinine statements, remind them that when they run their mouths they are responsible for the
garbage that rolls out.

More Black Helicopters

      June 2, 2001, The United Nations General Assembly has approved a gun control treaty that calls on all nations "to prevent, combat and eradicate the illicit manufacturing of and trafficking in firearms, their parts and components and ammunition."
      The treaty is supposed to make it easier to crack down on illegal gun trafficking by helping authorities trace the global movement of all new weapons.  It must be signed and ratified by at least 40 countries before it becomes international law.
      The signing period runs from July 1 through Dec. 12, 2002.  Under terms of the treaty, approved Thursday: All new firearms would have to be marked with a serial number and the place of manufacture.
      Nations would have to set up import-export licensing procedures. Countries could also be required to keep records on all guns, parts and ammunition made within their borders for 10 years. Nations are urged to pass laws making the illicit manufacture and sale of  firearms a criminal offense. Press reports said numerous countries have concerns about the treaty, which raises questions about whether it will ever take effect.
     National Rifle Association Executive Director Wayne LaPierre was unavailable for comment, according to an NRA spokesman.  However, Gun Owners of America isn't surprised at the U.N. action, according to spokesman Erich Pratt.  "This comes as no surprise because the U.N. is very much against the right of self-defense.  What they are doing now in terms of tracing has not been effective in curbing crime.  It has not even been effective in helping authorities find the perpetrators of crime.  Anywhere you look, gun control has failed to cut crime," Pratt said.  "But one thing that gun control has been effective at," Pratt said, "is registering law-abiding gun owners, and that seems to be what this treaty is aimed at encouraging governments to do is to register gun owners and being able to track law abiding gun owners," he said.  "That, of course, concerns us very much, since, historically, registration has been a first step to confiscation of firearms," Pratt added.  Handgun Control Inc. had no comment

Why Not Grab the B-B Guns Too?

     Wow! Now the Gun Nazis are after B-B guns, looks like they are going after everything. Now they apparently are hiding behind consumer protection, confiscating B-B guns, while claiming a flawed product. What a bunch of pathetic babble-speak.
     The government is suing one of the nation's top BB gun manufacturers in an attempt to force the recall of millions of air rifles alleged to have a dangerous defect. The Consumer Product Safety Commission voted 2-1 on Tuesday to file a lawsuit against Daisy Outdoor Products after the Rogers, Ark.based company repeatedly refused to negotiate a voluntary recall or other settlement, commission chairwoman Ann Brown said.
     The commission's suit targets 16 versions of Daisy's Power Line Airgun. The company has produced 4.9 million of the model 880 Power Line Airgun since 1972 and 2.4 million of the model 856 since 1984, the commission said.
     The complaint alleges that BBs can get stuck in the magazine of those models, leading users who can no longer hear pellets rolling around inside to believe the guns are unloaded. However, firing the BB guns can shake the pellets loose and shoot them out at extremely high speeds, the suit says.
     As a result, the alleged defect - which would cost $2 per gun to fix - has been associated with at least 15 deaths and 171 serious injuries, Brown said. "These aren't the same BB guns we all grew up with," Brown said.
     Daisy marketing director Joe Murfin said anyone who has been hurt has ignored clear warnings on the packaging on how to safely use BB guns. The packages say BB guns should never be pointed at a person and should only be used by those over 15, with parental supervision. "There is no defect with this product," Murfin said.
     The suit asks an administrative law judge to order a recall pulling all unsold products from store shelves nationwide. The commission also wants the company forced to wage a public awareness campaign and offer consumers free repairs, replacements or refunds for BB guns they have already bought.
     Mary Sheila Gall, the lone commissioner to vote against the suit, said six previous CPSC investigations of Daisy BB guns had found no defects. She also said the deaths and injuries represent a minuscule percentage of the guns sold.

Tax Bug Bites Tribes

     On November 27th, in a Certiorari submitted to the U.S. Supreme Court from the 10th Circuit, the Supreme Court ruled in a 7-2 decision that tribes are not exempt from paying gambling related taxes that IRS Section 2719(d)(i) of Chapter 35 of the Internal Revenue Code imposes upon State authorized gaming entities. This ruling will have significant impact upon 184 tribes that have casinos.
     In Chickasaw Nation v. United States, Justice Breyer delivered an opinion in which only Justices O'Connor and Souter dissented.  The opinion not only makes clear that tribes are required to pay gaming revenue taxes in the same manner as gaming entities of States, but ALSO clarifies application of a "canon of interpretation" that ambiguous language is to be construed liberally in favor of Indians.
     "One cannot say that the pro Indian canon is inevitably stronger (than a canon that all tax exemptions must be clearly expressed), particularly where the interpretation of a congressional statute rather than an Indian treaty is at issue."
     A significant example of the pro Indian canon was its successful use in an action challenging the Indian Civil Rights Act, and resulted in gutting enforcement of that Act, rendering the act essentially useless since its inception.
     This recent Chickasaw case discussion of the pro Indian canon will discourage future abuse of this legal canon in Indian litigations. This is the "double victory" - 1st about Indian gaming taxation, and 2nd about more prudent use of an often abused legal canon. So, the implications of this one case are:
   1) Section 2719(d)(i) of IRS Chapter 35 applies to tribes as it does to states;
   2) Use of the pro Indian canon is narrowed;
   3) The decision was supported by many liberal justices.
A good day and a good decision towards equal application of the law and even handed tax collection policies!
PARR Ed Note: This is a wonderful decision, nice to win one for a change. However, I can't help but wonder how much this will increase the burden on the taxpayers of Wisconsin. No doubt the state grants to the Tribes will increase in proportion with the additional amount of taxes paid by the tribes.

Lac du Flambeau Hasn't Lost its Knack for Spreading Charm.
      A dispute between the Lac du Flambeau tribe and property owners over an access road on the reservation has been settled. Friction arose a few years ago when the tribe erected a steel gate on the road and tribal officials told landowners they would each have to pay $42,000 for access to Marlands Lane.
     At the heart of the dispute was confusion over who owned the land where Marlands Lane crosses. The Town of Lac du Flambeau believed it had jurisdiction, so it taxed land owners for the road and maintained it.  The tribe, however, claimed ownership and insisted it had never granted right of way to the town.
     It was later determined that the land was owned by the tribe which led to the settlement between the tribe, town and four landowners, authorities said this week.
     For a one time payment, the tribe will grant right of way on Marlands Lane to the Town of Lac du Flambeau for use as a public road.  Just how much money will change hands was not disclosed, but officials termed the settlement "amicable."
 The town has agreed to grant right of way on three miles of road in down town Lac du Flambeau to the federal Bureau of Indian Affairs for the benefit of the tribe.
     "We have always maintained Marlands Lane as a town road and now we can continue to do so under a sound agreement," Town of Lac du Flambeau Chairman Francis Chartier  said.
     In a prepared statement, the Tribe  said, “jurisdiction over land such as the property where Marlands Lane traverses is important to the tribe's sovereignty.”
     For years, residents believed Marlands Lane belonged to the town.  Property owners at one point were assessed $10,000 to repave it and the town has been collecting federal gas tax money to help maintain the road since the 1930s.
     But the tribe believed it was the rightful owner of the land and in 1999 put up a steel gate on the road.  According to an 1854 treaty, travel on reservation roads was granted to non Indians but the tribe was to be compensated for providing transportation routes.

Proposed Lac Courte Oreilles Study, Fact or Fiction?
     Project ELF is one of several names under which the Navy's Extremely Low Frequency communication system has operated. It has been in place and operating for the better part of 4 decades. Every imaginable study has been made, and the results have always been the same. “No Effect.” The only altering phenomenon is that the wildlife is flourishing, due to accelerated underbrush growth, in the clearing where the antenna is located. Is this study necessary? Or is it an attempted rip-off of taxpayer dollars by The Lac Courte Oreilles and other Chippewa tribes? They will ask Congress for $2.115 million over three years to fund immediate studies which LCO says are necessary to find out if the U.S. Navy's Project ELF radio system is harming the health and safety of the four county region's human, animal and plant populations.
     On October 3, the Tribe held the last of five area public hearings at the LCO Convention Center to ask local residents and tribal members if they feel Project ELF is safe and should be upgraded as proposed by the Navy. The Tribe got some support for its request from the state's chief medical officer, Dr. Henry Anderson, the director of the Wisconsin Division of Health and Family Services.
     Project ELF is the Navy's Extremely Low Frequency (ELF) transmitter and antenna system based near Clam Lake, Wis., and Republic, Mich., that allows coded messages to be sent to U.S. nuclear submarines operating deep below the ocean's surface.
     In the national forest south of Clam Lake, ELF includes 28 miles of antenna lines and buried cable, forming an X.  The
system continuously pumps 1.3 million watts of electricity through the antenna, which feeds the signal into the ground.  The signal bounces off the bedrock and up into the ionosphere and radiates out deep into the oceans, where Navy submarines can pick it up.
     The Navy says there is no proof that the system causes human or biological damage, and that the system is essential to the nation's security system.
     The LCO Tribal Health Board has recommended that seven studies be done immediately, including a comprehensive three-year, $600,000 cancer study coordinated by the Wisconsin Division of Health of the area where Project ELF is located Ashland, Bayfield, Sawyer and Price counties.
     "Strong protocols have been developed for all of these studies; they're ready to go if we can get Congressional funding to conduct them," said Dan Peterson, director of the LCO Tribe's Department of Defense Initiative.
     Also, LCO has recommended a $350,000 human breast cell study, to be performed by the UW-Parkside Department of Physics; a measurement and determination of the impacts of ELF stray currents in the national forest; a study to find out if ELF has an impact on native plants in the national forest; a $550,000 study by Great Lakes Water Institute to find out if ELF is impacting fish populations, including the Chippewa River, Moose Lake and the Chippewa Flowage; a study by Northland College of Project ELF's impact on wetlands and amphibians; and a cultural resource and impact survey, to be performed by the tribe's historic preservation office.

Global Warming— Fact or Fiction

     The media propaganda war on global warming continues with environmentalist statements predicting doom and gloom based on what is becoming more and more evident is "junk science."  The National Academy of Science recently released a report on global warming where the summary statements seemed to support the warming theory.
     Many of the scientists that were part of the researchers who prepared the report are very unhappy with the summary.  Many are saying publicly that the evidence does not support global warming of any significance especially not human activity.  For example, Steven Mallory, an adjunct scholar at the Cato Institute says, "The recent temperature record complied from balloon and satellite measurements inexplicably don't show any warming."
     Paul Georgia referring to a recent study in the Bulletin of the American Meteorological Society … "even if warming were to occur, mean surface temperatures were much higher during the Medieval Warm Period (roughly 800 to 1200 AD) than they are today.  The warmer temperatures during that period allowed the Vikings to settle presently inhospitable Greenland."
     "The claimed temperature rises of the past few decades is based entirely on surface data from poorly controlled stations and sea surface measurements (of water, not air, temperatures); those measurements are terribly suspect.  The NAS refuses to include the climate cooling that took place between 1940 and 1975, so obviously at variance with the increase in greenhouse gasses.  It completely ignores the data from weather satellites and radiosondes, which show no appreciable warming since 1979.  In addition, none of the many proxy measurements (tree rings, ice cores, etc.)  shows any warming trend after 1940."  S. His heart was pumping frantically and he tried to run even faster. He tripped and fell on the ground. He rolled over to pick himself up but saw the bear right on top of him, reaching for him with his left paw and raising his right paw to strike him. At that instant the Atheist cried out:  “Oh My God” Time stopped. The bear froze. The forest was silent. As a bright light shone upon the man, a voice came out of the sky: "You deny my existence for all of these years, teach others I don't exist, and even credit creation to a cosmic accident. Do you expect me to help you out of his predicament? Am I to count you as a believer?"
